Terms

The rules for creators and brands on nser. For every deal, the brand buys from nser and nser pays the creator, so both sides deal with one company.

Platform terms

Everyone who uses nser agrees to these.

  1. Who we are. nser is run by Avinash Acharya V as a sole proprietorship, Bengaluru, Karnataka, GSTIN 29ETZPA3185E1Z7. Contact: hello@nser.in.
  2. What nser is. nser is a website where brands book creators. For every deal, nser is the seller: the brand buys the work from nser, and nser engages the creator as an independent subcontractor. nser is not a talent agency. Brands choose creators themselves, and creators are free to work anywhere else. nser does not promise views, sales or results.
  3. Who can use nser. You must be 18 or older. Brands must be a business or act for one. Give true details and keep one account per person or business.
  4. Verification. nser may check identity, social media stats and brand business details. Creator stats show as “self-reported” until nser can check them. A brand nser has not checked shows as “Unverified”. A verified label means only that nser checked those details. It is not an endorsement.
  5. Fees and the split. Creator pages are free. On deals a brand books through a creator’s own nser link, the creator gets 100% of their price and the brand pays nser’s fee on top. Every deal shows what the brand pays, what the creator gets and what nser keeps. nser gives 30 days’ notice before changing its fee.
  6. Creator stores. Creators can sell their own digital products (guides, presets, templates) from their page. For these, the creator is the seller and is responsible for the product; nser is the platform that runs checkout and delivery, and keeps a fee on each sale (plus GST on that fee). Products offering stock tips, trading calls, investment advice or betting tips are not allowed, and nser may remove any product. Refunds follow the Refund policy.
  7. Talking on nser. Brands and creators talk only in the chat on the deal page. Until a deal is paid, phone numbers, emails, UPI IDs, WhatsApp and Instagram contacts in messages are hidden automatically. nser keeps the chat as the record if there is a dispute.
  8. Brands nser does not work with. Real-money gaming and betting, alcohol and tobacco (including surrogate ads), and investment or financial advice from people not registered to give it.
  9. Content rules. You are responsible for what you post. No illegal, misleading or copied content, no fake followers or engagement, and paid posts carry an ad label. nser may remove content or suspend accounts that break these rules.
  10. Disputes on a deal. If a brand and creator disagree, nser reviews the deal page and its chat and decides: approve the work, ask for a repost, replace the creator, or refund the unpaid part. Money already paid out is final.
  11. Liability. On any deal, nser’s total liability is what the brand paid for that deal. Otherwise it is the higher of the fees you paid nser in the 6 months before the claim, or ₹10,000. nser is not liable for indirect losses such as lost profit.
  12. Suspension and closing accounts. nser may suspend or close accounts that break these terms, after notice except in cases of fraud or legal risk. You can close your account at any time. Deals already in progress finish first.
  13. Privacy. nser handles personal data as its Privacy policy says, under India’s Digital Personal Data Protection Act, 2023.
  14. Instagram and YouTube. If you connect YouTube, you also agree to be bound by the YouTube Terms of Service. Connecting Instagram is also subject to Instagram’s Terms of Use.
  15. Grievance officer. Avinash Acharya V, grievance@nser.in. Complaints are acknowledged within 24 hours with a ticket number and resolved within 15 days.
  16. Law and courts. Indian law applies. Disputes go to the courts at Bengaluru, or to a single arbitrator in Bengaluru under the Arbitration and Conciliation Act, 1996, if both sides agree. Your rights under consumer law are not affected.
  17. Changes. nser gives 15 days’ notice by email of important changes. Using nser after that means you accept them.

Creator agreement

Creators accept this when they publish their page. It adds to the platform terms.

  1. Your page and content. You own everything you upload. You let nser show it on nser and use it to promote nser. Deleting it ends that permission.
  2. True stats. Your follower and engagement numbers must be real. nser may remove your page for fake followers or bought engagement.
  3. Accepting a deal. When you accept a deal, you agree to deliver it for nser, which has sold it to the brand on the same terms.
  4. Delivering. Send the draft by the deadline. If you are more than 3 days late, the brand gets a full refund automatically and you are paid nothing for that deal.
  5. Revisions. The brand gets up to 2 rounds of changes within the original brief. Anything outside the brief is a new deal at a new price.
  6. Posting. Post only the approved version, on the agreed account, with an ad label (#ad, #collab, #promo, #sponsorship or #partnership) as ASCI requires, and tag the brand.
  7. Keep it up. The post stays live, unedited and labelled for the live period: 30 days unless the deal says longer. If it comes down early, repost within 3 days. Deleted before day 7, the brand gets a full refund. Deleted later, the 30% still held goes back to the brand. A takedown you did not cause is handled as a dispute.
  8. Getting paid. How you are paid depends on the deal type and is shown on the deal page:
    • Posts: 70% in the weekly payout after the post has been live 7 days, 30% when the live period ends.
    • UGC: 100% within 48 hours of the brand approving it.
    • Events: 100% within 48 hours of the brand confirming you showed up.
    • Ambassador campaigns: each approved piece in the weekly payout.
The brand has 72 hours to respond at each step. Silence counts as approval. Payouts go to your bank account.
  9. Your taxes. nser asks for your PAN and bank details at your first payout. You confirm the PAN is yours. If it is wrong, you bear any extra tax or penalty. Any tax nser deducts is shown on your payout. You pay your own income tax.
  10. Usage rights. The brand can use your content only as the deal says. If it says nothing, the brand may reshare it on its own social accounts for 12 months with credit to you. Paid ads and longer use are priced add-ons on the deal. No one may use your content to train AI without your written consent.
  11. Your responsibility for content. You confirm you have the rights to all music, images and claims in your post. If nser must refund a brand because you broke this agreement, you repay nser.
  12. Independence. You are an independent subcontractor, not nser’s employee or agent.

Brand agreement

Brands accept this before their first payment. It adds to the platform terms.

  1. Who you are. Give your business name, GSTIN if registered, and the name of the person who approves deals.
  2. The deal. You set the brief, deadline and any add-ons such as ad usage rights or a longer live period. Your contract for the deal is with nser, and nser engages the creator to deliver it.
  3. Paying. You pay the creator’s price plus nser’s fee plus 18% GST upfront, before work starts. You get one tax invoice from nser.
  4. TDS. On deals over ₹30,000 you can tick “I’ll deduct TDS”, pay 1% less, and share the TDS certificate.
  5. Reviewing. You have 72 hours after each draft and after the post goes live to approve, ask for changes within the brief (up to 2 rounds), or raise a dispute. If you do nothing in 72 hours, it counts as approved.
  6. Refunds. There is no cancel button after payment. Refunds happen only as our Refund policy describes.
  7. Your product claims. You are responsible for every claim in your brief and for the product itself.
  8. Usage rights. Use the content only as the deal says. Do not use creator content to train AI without the creator’s written consent.
  9. Liability. nser’s liability on a deal is capped at what you paid for it. The remedy is a repost, a replacement creator, or a refund of the unpaid part.
  10. No guaranteed results. Neither nser nor the creator promises views, reach or sales unless the deal says so in writing.
